MasterShot Solutions LLC ("MasterShot," "we," "us," or "our") prioritizes the privacy of all individuals who interact with our website where this Privacy Policy is shared (the "Site") and extends to the services and software we provide (collectively referred to as the "MasterShot Features"). This Privacy Policy outlines our approach to safeguarding the information collected via the Site or the MasterShot Features and explains how this information is used, protected, and sometimes disclosed. By visiting the Site or utilizing any of the MasterShot Features, you are agreeing to the practices described in this Privacy Policy regarding your information. This policy is effective from the date mentioned above and applies exclusively to the Site and MasterShot Features, not to any other websites you might access through them, which may follow different procedures and policies regarding data.

This policy answers the following questions:

  • What choices do you have about the collection and use of your personal information?

2: Your rights and your preferences: Giving you choice and control

MasterShot puts you in control of how we process your personal data. If we send you electronic marketing messages based on your consent or as otherwise permitted by applicable law, you may, at any time, respectively withdraw such consent or declare your objection (“opt-out”) at no cost.

3: How We Collect Your Personal Data

We collect your personal data in the following ways:

1. When you sign up for the MasterShot Service - when you sign up for MasterShot Features, we collect certain personal data so you can use the Service such as your name, email address, company name, etc.

2. Through your use of the MasterShot Features - when you use the MasterShot Features, we collect personal data about your use of MasterShot Features, such as your activity log, phone number, addresses, etc.

3. Personal data collected that enables us to provide you with additional features/functionality - from time to time, you also may provide us with additional personal data or give us your permission to collect additional personal data e.g. to provide you with more features or functionality. As described further below, we will not collect files, media, or application data without your prior consent. You always will have the option to change your mind and withdraw your consent at any time.

We use anonymized and aggregated information for purposes that include testing our IT systems, research, data analysis, creating marketing and promotion models, improving the MasterShot, and developing new features and functionality for MasterShot Features.

4: Types of Information We Collect

Personal information means information that can be used to identify and contact you. You do not need to submit personal information to access the MasterShot Features generally. However, you may be required to submit personal information to access certain aspects of the Site and the MasterShot Features. We may collect non-personal information such as your browser type, when you accessed the MasterShot Features and from what physical location you accessed the MasterShot Features. This information may be aggregated to measure the number of visits, average time spent, page views, and other statistics about users of the MasterShot Features. We also may use this data to monitor the MasterShot Features’ performance and to make the MasterShot Features easier and more convenient to use.

We collect personal information when you create an account through the MasterShot Features; participate in registration forms, order forms, feedback forms or surveys; purchase a product through the MasterShot Features; participate in forums, news groups, or bulletin boards on the Site; use third-party applications such as Intercom or Google Analytics; or receive customer or technical support.

To create an account for the MasterShot Features, we require you to provide certain information to create your profile, including your name, company name, email address, and password. Providing additional information beyond what is required to create an account, including your profile picture, phone number, or company address is optional, but enables you to gain more from the MasterShot Features.

When purchasing a premium plan or subscription through the MasterShot Features, you will also be required to provide a credit card number, billing address, phone number or other payment information. No information of this type will be collected unless you have registered for services that require it.

By submitting personal information through the Site, you authorize MasterShot to share this personal information for the purposes identified herein and on the Site, such as responding to user inquiries, processing transactions, distributing materials, and requesting feedback.

5: Third Party Privacy Policies

Through the MasterShot Features, you may be able to link to technology, software, and services owned and controlled by third parties (“Third Party Features”). You may be permitted or required to submit personal information to access Third Party Features. Such use of Third Party Features and submission of information through Third Party Features will be subject to such applicable third party’s terms of use, terms of service, and privacy policy. You agree to look solely to the applicable third party and not to MasterShot to enforce your rights in relation thereto. When you have clicked on a third-party logo or URL displayed on the Site, or accessible through the MasterShot Features, which links you to any Third Party Features, our Terms of Use no longer applies and you must read the terms of use, terms of service, and privacy policy of the third party to see how your personal information will be handled on their website.

6: How We Use Your Personal Information

The personal information you provide to us will allow us to communicate with you and provide the MasterShot Features to you, depending on the MasterShot Features for which you register. This includes alerting you of new products or services, features, or enhancements to the MasterShot Features; verifying your identity; handling your customer service questions or issues; processing orders; requesting feedback; distributing newsletters; and notifying you of promotions, updates, or special offers that we think may interest you. We may also use your email address as part of the MasterShot Features in sending you messages about the MasterShot Features and other general announcements. We keep track of your interactions with us, including but not limited to your activity within the MasterShot Features. Except as set forth in this Privacy Policy, or unless we have your consent, we will not share your personal information with any person or entity other than those affiliated with us, entities acting on our behalf, and relevant third parties such as those needed to collect and maintain our information collection servers and perform technology and related services.

We may use your personal information with non-personal information that we have collected in a manner such that the end-product does not personally identify you or any other user of the MasterShot Features. We may make your personal information non-personally identifiable by either combining it with information about other users (aggregating your personal information with information about other users), or by removing characteristics (such as your name or email address) that make the information personally identifiable. This process is known as de-personalizing your information. You grant us a royalty-free, worldwide, perpetual, irrevocable and fully transferable right and license to use your personal information in connection with the creation and development of analytical and statistical analysis tools relating to the use of the customer data we collect in providing the MasterShot Features (the “Analytical Data”). We are expressly authorized to make any commercial use of the Analytical Data, including without limitation, sharing the Analytical Data with third parties, provided that we do not sell, trade, or otherwise transfer from us any part of the Analytical Data that personally identifies any MasterShot Features users.

All data collected strictly remain for MasterShot internal use only. MasterShot is the sole owner of the information collected on its websites.

We may use your personal information to:

  • prevent and detect fraud or any other prohibited or illegal activities;
  • protect the security and integrity of MasterShot websites and services;
  • fulfill your requests for registration;
  • process your online services orders;
  • facilitate the use of MasterShot Features or websites;
  • help us customize content and make it closer to your needs;
  • inform you of any important news on MasterShot Features, relevant to you;
  • inform you of new services release and product updates;
  • communicate with you about technical or functional problems;
  • send you special offers and events that may interest you;
  • promote our products and services on our website and those of our partners;
  • improve MasterShot Features and websites.

If you are located in the European Economic Area, we may process your Personal Information for the above purposes when:

  • you have consented to the use of your Personal Information, For example, we may seek to obtain your consent for our uses of cookies or similar technologies, or to send you marketing communications.
  • we need your Personal Information to provide you with services and products requested by you, or to respond to your inquiries,

  • we have a legitimate interest in using your Personal Information. In particular, we have a legitimate interest in using your Personal Information to ensure and improve the safety, security, and performance of our Service, to anonymize Personal Information and carry out data analyses.

7: Do Not Track

In compliance with California legislation, AB370, effective January 1, 2014, MasterShot’s practices in responding to “do not track” signals and collecting user information over time and across a network of websites when you visit the Site are as follows: We honor the request of “do not track” signals sent by your browser when you visit the Site. Additionally, MasterShot does not collect user information about your online activities over time and across different websites, or authorize third parties to do so.

8: Google Analytics, Mixpanel, Intercom, HotJar, Sendgrid and Stripe

MasterShot currently uses Google Analytics, Mix Panel, Intercom, HotJar, Sendgrid, Twilio, and Stripe to help us learn about who visits the Site and what pages are being viewed. MasterShot reserves the right to use different analytics software that serves similar purposes in the future.

9: Cookie Policy

“Cookies” are small bits of electronic information that a website sends to a visitor’s browser and are stored on the visitor’s hard drive. Like many websites, we employ cookies in certain areas of the Site to allow us to provide information to make your online experience more convenient. For example, when you return to the Site after logging in, cookies provide information to the Site so that the Site will remember who you are on subsequent visits, speeding up or enhancing your experience of the MasterShot Features by, for instance, tailoring content to you. Cookies may also be used to keep track of your role, session identification, and your login name and password. While MasterShot may use cookies to track your visit to the Site, this information does not identify you personally and you remain anonymous, even if you have previously submitted personal information to MasterShot through the Site or otherwise. You may still access the Site and the MasterShot Features if you set your browser not to accept cookies.

Third parties whose websites are accessible through links on the Site may also use their own cookies when you link to their site or service. MasterShot does not control these third parties’ use of cookies and cannot guarantee that they will uphold the same privacy standards as MasterShot. MasterShot expressly disclaims any and all liability related to the collection, use or disclosure of information by third parties. You should review the privacy policies of any third-party sites that you visit through a link from the Site to understand how these third parties use cookies and the information they collect through cookies. Most cookies are “session cookies” which means that they are automatically deleted at the end of each session. Most browsers are initially set to accept cookies. You can set your browser to notify you when you receive a cookie, giving you a chance to decide whether or not to accept it.

10: DMCA Compliance

Incorporate a section dedicated to how MasterShot handles copyright infringement claims under the DMCA. This should include the process for reporting alleged infringements and how MasterShot responds to notices of violation.

11: Log Information

Our servers automatically record information that your browser sends whenever you visit the Site. This information includes your Internet Protocol address, your browser type and version, the search engine you used to find the MasterShot Features, if any, which MasterShot Features you use and from where, when and how long you use them, and if and when you are using the MasterShot Features at a particular event. We use this information to monitor and analyze how users use the MasterShot Features, to provide customer service and to maintain and improve the MasterShot Features. We may also collect similar information from emails we may send to you which then help us track which emails are opened and which links are clicked by recipients. The information allows for more accurate reporting and improvement of the MasterShot Features.

12: Data Transfers

MasterShot is based in the United States. Personal Information that we collect may be transferred to, and stored at, any of our affiliates, partners or service providers which may be inside or outside the European Economic Area (“EEA”) and Switzerland, including the United States. By submitting your personal data, you agree to such transfers. Your Personal Information may be transferred to countries that do not have the same data protection laws as the country in which you initially provided the information. When we transfer or disclose your Personal Information to other countries, we will protect that information as described in this Privacy Policy.

13: Children’s Privacy

We do not knowingly collect personal information from children under 13, or allow them to create an account for the MasterShot Features. We take children’s privacy seriously, and encourage parents to play an active role in their children’s online experience at all times.

14: Sharing Your Information with Third Parties

We use your personal information to provide the MasterShot Features to you, deliver products and services you request, complete transactions, handle your customer service questions or issues and send communications to you about promotions, updates, or special offers from MasterShot that may be of interest to you. The personal information uploaded by you through the MasterShot Features will be shared only with authorized persons to whom you specifically grant access. We may also use your depersonalized personal information to provide analyses of our users in the aggregate (including Analytical Data subject to the terms of this Privacy Policy) to prospective partners and other third parties.

If you choose to disable your account, we will retain your contact information and may keep other account details for a reasonable period afterward for internal account management and fraud prevention purposes.

You may update or delete your personal information or modify your account preferences for the MasterShot Features by accessing the account interface provided through the MasterShot Features. Please note that if you disable your account, we will keep your contact information on file, and may retain other account information for a reasonable period of time afterward for the purpose of internal account management and fraud prevention activities.

17: Opting Out of Receiving Communications From Us

If you no longer want to receive our newsletter, emails or other announcements, you may unsubscribe by writing to us at support@mastershot.io or following to the “unsubscribe” link at the bottom of our emails. Please note that you cannot unsubscribe from certain correspondence from us, including messages relating to your account transactions.

18: Safeguarding Your Personal Data

We store your personal data on servers located within secure facilities, guarded by strict access controls, and shielded by various security protocols and measures aimed at protecting your information. Access to your personal data is limited to MasterShot employees, contractors, and agents who require this information to help design, run, and improve the MasterShot Features. Furthermore, everyone granted access to personal data is adequately trained in its secure management. Despite our efforts, the inherent nature of the internet means we cannot guarantee absolute security for data transmission or storage. Therefore, when you transmit personal data to us or use the MasterShot Features, you do so knowing and accepting the risk. Upon receiving your data, we commit to doing everything within our power to ensure its security on our systems. We do not store sensitive information like credit card numbers after the completion of transactions. However, Stripe, our third-party payment processor, may retain personal data for transaction processing as needed.

19: Trademark Information

MasterShot is a registered trademark of MasterShot Solutions LLC. Unauthorized use of this trademark is prohibited and may be a violation of federal and state trademark laws.

20: Updates to Privacy Policy

We reserve the right to amend this Privacy Policy over time. Any changes will be prominently posted on the Site.
